Bank of America To Pay Record $335 Million To Settle Mortgage Discrimination Case

Bank of America Corp.’s Countrywide Financial unit agreed on Wednesday to pay a record $335-million (U.S.) to settle civil charges that it discriminated against minority home buyers, a historic settlement for the Obama administration in the wake of the subprime mortgage morass.

As the financial crisis was building in 2008, Bank of America bought Countrywide, which specialized in so-called subprime mortgages, focusing on loans to those with lower credit ratings and charging them higher interest rates.

The settlement covers conduct between 2004 and 2008 before the acquisition by Bank of America, and involves a range of alleged wrongdoing including charging African-Americans and Hispanics higher interest rates and fees than non-minorities.

Minorities also were steered to more expensive subprime loans even though they were qualified for traditional mortgage rates. U.S. Justice Department officials said it was the largest residential discrimination settlement in U.S. history.

“The victims had no idea they were being victimized. They were thrilled to have gotten a loan and realize the American dream,” Thomas Perez, head of the Justice Department’s civil rights division, told reporters. “This is discrimination with a smile.”

Recently Intellpuke posted an open letter to financial institutions that accused them of applying false charges to patron's bills as part of their business model, and gave personal examples of this

Since then we noticed an extra charge on our bank account of 1.50 for using an ATM. We seldom use ATMs because of the additional fees involved but once every year or so we find it necessary. This happened recently and when we got our bank statement there were the usual fees and an additional one that was in error.
Previously we had a dispute with US Bank who held our home mortgage. They were running a scam with the way that they dated our mortgage payment, making it seem that the payment was late in order to charge a late fee when in fact it had been early. After hours on the phone with lemmings representing the bank that were unable to verify their claim that the payment was late, we finally got forwarded to someone that verified our claim and deleted the late charge. (Since that time we made all of our mortgage payments at a bank branch in order to have verification of the time of payment. A year ago we payed off our home and are now mortgage free. Part of the joy of this is not having to deal with an entity that we know to be scoundrels.)
We believe this is also part of the business strategy, to make dealing with these entities so frustrating that the average person will not make the attempt or give up because it is not worth the effort over the small amounts being scammed.
Thirdly, we were shopping at Macy's recently and the salespeople there said that if we applied for a Macy's card that we would recieve a 20% discount on the purchase at checkout for that purchase and an additional 20% on the first credit card bill. We stated that we did not want to accrue any bill but wanted to pay everything off that day. The store clerks said that was no problem and calculated the additional 20% discount, and let us pay that amount at the store after we had put the charge on their card. When we got the bill we owed $5. When we called to protest we were informed that we had been misinformed by someone at the store, that there was an additional 15% discount on the first purchase not the 20% we had been told. After more hassle we got the fee removed with the corporate minions claiming that someone at the store misunderstood the promotion. But it wasn't one person at the store. We had dealt with several of the staff at this particular Macy's because we insisted on paying off the charge immediately, at least a couple of which were part of the store management. We suspect that the business model was to intentionally misinform the sales staff because most people do not pay off their charges at the time of purchase and will await the arrival of the first bill. When it arrives there is an additional discount that is less than promised but who will quibble at that point? If someone does call in to complain they would be told that they were misinformed by the sales person, putting the helpful courteous salesperson up as the culprit, easily forgiven, rather than the placing the blame on the unscrupulous soulless corporate machine.
In each of these cases there is plausible deniability by the corporate entities at fault. They claim in each instance that they were unintentional honest mistakes. We ask ourselves are we paranoid or is there really an intentional business model to scam using plausible deniability as a smokescreen? If these were really honest mistakes it would stand to reason that there would be an equal number of mistakes under-charging as over-charging. In our experience we have only found instances of over-charging
